Police Testimony 101

Austin Criminal Defense Lawyer  Sun, 02/28/2010 - 8:02pm

From PoliceOne.com, comes Pat McCarthy’s article “Turning Testimony from Stressful to Successful”.

Before we get to the parts that a skeptical defense lawyer might highlight on his blog, let me give some kudos to the subtitle:

The baseline for all good witnesses is to just tell the truth — the benchmark for cops on the stand is that we're just doing our jobs

Austin is Very Very Very Lucky

AustinTowers Downtown Condo Blog  Mon, 02/15/2010 - 9:39pm

2009 was a tough year for job creation in the United States. Since job creation drives home prices, the 2009 job losses are likely to leave a lasting impact.

How lasting?

Economists estimate that it may take the United Stated 125 months (10+ years) to fully recover the jobs lost during the great recession of 2009.

In Texas, which had the strongest job growth of any state over the last decade, it is predicted to take 37 months or just over 3 years for the job losses to be recovered.

From a recent PC affidavit:

…The tin contained four marijuana roaches and 6 small round pills with 2530 on one side and the letter v on the other.

[Jamie’s client] said that the pills were Klonopin. I asked [Jamie’s client] if she had a prescription for Klonopin and she said she did not.

The pills were identified as Clonazepam via the Epocrates iPhone Pill Identification Application.

From Ron Coleman’s new blog/website, “Federal Criminal Lawyer – Frequently Asked Questions”, comes this post titled in the form of a question, “How Can You Avoid a Minimum Mandatory Sentence in Federal Court?”:

In federal court, there are only two ways to avoid such a sentence:

Can judge still sentence jail after acquittal? – The answer is supposed to be “No”, but that’s not always the case.

Answers From A Criminal Defense Lawyer On A Prosecutor's Blog

Austin Criminal Defense Lawyer  Fri, 12/04/2009 - 3:54pm

If, hypothetically, a prosecutor were to start a semi-regular series of posts, consisting of the same 4 or 5 questions, posed to and answered by individual criminal defense lawyers (and, of course, linking to the CDL’s blog or website), what should those questions be?

The Apple Doesn't Fall Far

One of Sam’s teachers told me that he was the class clown. (When my wife was told the same thing at a parent-teacher conference, she said it must be genetic.)

Sounded possibly like a bad review of his behavior, but the teacher assured me that it wasn’t, that he just says things that make even his teachers laugh.

And apparently at a much greater rate than most 3 year olds.

He also knows how to play straight man for his twin brother.

Both of them at times like to speak in lists. Here’s a recent example:

Overheard

Austin Criminal Defense Lawyer  Wed, 09/30/2009 - 1:39pm

Waiting in line for a down elevator after getting out of court this morning, a lawyer and a client talking about having the ignition interlock on his car "the whole time" while his case was pending:

Client: I haven’t gotten into any trouble for almost two years.

Lawyer: …and for you, that’s actually really impressive.

The lawyer had a big grin on his face, and the client laughed.

Why Was 6 Afraid Of 7?

Because 7-8-9.

[Two quick excuses: Sorry for being corny, but the twins are about to turn three, and my humor literally tends to run on the juvenile side these days – yes, more juvenile than before I had children.

Also, I don’t expect to be alive a hundred years from now, so if I’m ever going to post this “joke”, then today’s the day to do it.]
